
In science, we do experiment to realize whether it fixes the problem or not, then we make a way forward. But in our national politics, what happened is the same experiment has been done through same chemicals many times without changing the single parameter just to make other believe that we really don’t have any other options to accommodate in our politics. Hence, many Prime Ministers tried to do every possible way to stick to the power using every possible propaganda or trick. Meanwhile, forceful and assertive movement with greater anguish has gained the leaping momentum in larger swath of the country, for which the same previous failed experiment records were employed in similar parameter to contain it. When they lose their patience, they tried to institutionalize another horrible act, "state-sponsored enforced disappearances". Hence, we were in virtual reign of terror imposed on the people in this decade-long war. The problem of the disappeared in Nepal is very much tied to the overall problems of a revolution in ferment - and the inevitable counter-revolution on its heels. What a surprising shame is, this was engineered by the leader of most democratic forces existing in the country and what they say is it is only a party that can respect and plead for human rights. Even now, people have clearly spoken against them very strongly to have a change “the change”, but we are being mere spectator until now.
It is not only me spoken against, the UN has clearly stand with this emotional set back; Enforced disappearance is defined in the 1992 U.N. Declaration on the Protection of All Persons from Enforced Disappearance as:
“Persons are arrested, detained or abducted against their will or otherwise deprived of their liberty by officials of different branches or levels of Government, or by organized groups or private individuals acting on behalf of, or with the support, direct or indirect, consent or acquiescence of the Government, followed by a refusal to disclose the fate or whereabouts of the persons concerned or a refusal to acknowledge the deprivation of their liberty, thereby placing such persons outside the protection of the law”.
It further says on the Protection of All Persons from Enforced Disappearance requires in Article 3 that each state "take effective legislative, administrative, judicial or other measures to prevent and terminate acts of enforced disappearance in any territory under its jurisdiction." Article 6(1 ) states: 'order or instruction of any public authority, civilian, military or other, may be invoked to justify an enforced disappearance."
Standing on this ground of UN declaration, to which Nepal is a signatory country, leaving behind the degraded emotional value of grieved people, rising frustration against the state and confusion among the family members to accept the fact, make the scenario more complexes, intolerable and eventually turn into greater anguish as it is not limited to dozens, not hundreds but it is in thousands.
Seeing and experiencing the facts by myself can say that It would be rather easy to deal with the pain if someone died due to age factor, illness, or accident as we lost the hope to see him/her in any days ahead of the date. At worst, some unexpected death that really hurt to some loved one but it doesn’t necessarily need to wait for the fate, just need the healing time, eventually everyone can accept it at the end. On contrary, the disappearance can cause many consequences, not only loose the earning hands but also need to expense the productivity of the second most efficient hand from the family to trace out his loved one effectively, leaving the pain for waiting far behind. The emotional problem of the family never stopped as mind could be confused to wait to see or accept the dead at worst. No matter, how strong the people in regard of his position, tolerance and financial background, but all should come forth from the heart and it will be weakened in every second loosing the patience day by day. It was me on a long queue in 1999 with very few other people to share my pain as it was the time for beginning of sate-engineered disappearances. The community now increased like hazardous fire spread on bush in drought exists in USA and Australia.
Much more water has flown in Bagmati not only during the war time, and the time when we were looking around in every possible corner from town center to police post, barrack to Supreme Court, Pulchowk to Baluwatar, but nothing is in progress. Maoist lead war, later staged people movement II, has brought the change, madhesh movement was lunched, election was over, many political settlements has been done but we are not eyeing in any steps taken to address such grievances of those family who are waiting their loved one, we are just asking bring alive or dead our loved one, compensate and recognize standing on International norms and brought the culprit to justice. Synergistically combined impact of confusion and frustration of its people spread in larger swath doesn’t help Nepal to make it new if we really want to do so. New Nepal should be made and reign and lead by new and ethical mind set up but not by corrupt and empty moral values and norms.
